Thank you for choosing Birdwatching EastAfrica Tours . (trade name: Birdwatching EastAfrica Tours) as your trusted travel partner. We are dedicated to providing exceptional birdwatching experiences across East Africa, ensuring your journey is enriching and seamless. Before booking, carefully read and understand the following terms and conditions. We are happy to clarify any questions.

On all booked trips, the additional terms and conditions from Birdwatching EastAfrica Tours. These terms apply universally to all trips, regardless of the travel year.

Birdwatching EastAfrica Tours’s terms prevail in all situations unless otherwise specified.

These terms govern services provided by Birdwatching EastAfrica Tours (hereinafter “BEAT”, “we”, “us”) to you, our client (“client”, “traveler”, “you”), and the use of our website, social media, mobile app, and online portals. They supersede conflicting terms from external entities.

Privacy and Data Protection

We protect your privacy and handle personal data per our Privacy Policy. By using our services, you consent to data collection, use, and disclosure as described.

Modification of Terms

We reserve the right to update these terms at any time. Changes take effect immediately upon posting on our website. Existing clients will receive email notification of revisions, which apply automatically unless objected to in writing within two weeks.

Intellectual Property

Content, logos, trademarks, and intellectual property on our website (www.birdwatchingeastafrica.com) are owned by or licensed to BEAT. Unauthorized use, reproduction, or distribution is prohibited without prior written consent.

Pricing

4.1 Website Pricing
Prices on our website are per person (unless stated) in USD ($). Exclusions: visas, border taxes, tips, insurance, personal expenses, and child/peak-season discounts. Prices are guidelines only; actual costs are confirmed in quotations valid for 4 weeks.

4.2 Surcharges
Surcharges may apply due to increased transportation costs (fuel, airfares), park/reserve fees, or exchange rate fluctuations. We reserve the right to adjust prices up to 20 days before departure. Surcharges exceeding 10% of the total price entitle you to cancel for a full refund.

Booking, Payments, and Cancellations

5.1 Booking Confirmation
After requesting a quote, you’ll receive a detailed itinerary via email. Confirm acceptance or suggest modifications promptly. Services are subject to change due to unforeseen circumstances (e.g., weather, security).

5.2 Payment
Pay via bank transfer, debit/credit card. A 35% deposit is due within 10 days of invoicing; full payment required if booking within 61 days of departure. Missed payments may result in cancellation (see Section 5.3.1).

5.3 Cancellations

  • By Client:
    • 61+ days before departure: Deposit forfeited.
    • 0–60 days: 100% of total cost.
  • By BEAT:
    • Trips >6 days: Cancel up to 20 days prior.
    • Trips 2–6 days: Cancel up to 7 days prior.
    • Trips <2 days: Cancel up to 48 hours prior.

No refunds for force majeure (Section 15.1).

Modifications

6.1 By Client

  • Within 10 days: Free corrections (e.g., typos); later changes incur fees.
  • 61+ days before departure: Modify itinerary/date (admin fee: $150).
  • Up to 7 days before departure: Replace traveler (admin fee: $250).

6.2 By BEAT
Minor changes (e.g., flight times) do not warrant compensation. Major changes (e.g., itinerary overhaul) entitle you to accept, request a price reduction, or cancel for a refund.

Insurance

Comprehensive travel/medical insurance (including emergency evacuation) is mandatory.

Medical Conditions

Disclose disabilities/medical needs at booking. We may decline bookings if accommodations cannot be met.

Travel Documents

Clients are responsible for valid passports, visas, and vaccinations.

Liability Limitations

BEAT’s liability is capped at three times the travel sum. We are not liable for third-party services, force majeure, or client negligence.

Risks

Birdwatching involves inherent risks (e.g., terrain, weather, wildlife). Follow safety guidelines; BEAT is not liable for non-compliance.

Jurisdiction

East African law governs all agreements. Disputes fall under Kenya courts.
